Massive New Fee for H-1B Visa Applications: What You Need to Know

On September 19, 2025, a presidential proclamation was signed introducing a one-time $100,000 fee on all new H-1B visa applications. This marks one of the most dramatic changes in recent history to the H-1B program and could significantly reshape how U.S. employers hire foreign workers.


Previously, standard H-1B fees ranged from $2,000 to $5,000—making this increase a seismic shift for employers and applicants alike.


Details of the H-1B Fee Increase


  • Effective date: The new fee took effect at 12:01 a.m. ET on September 21, 2025.

  • Who is affected: The $100,000 fee applies to new H-1B petitions filed on or after the effective date.

  • Who is not affected: The fee does not apply to renewals or existing H-1B visa holders.


Impact on Employers


Because the fee must be paid by the employer, this change will drastically alter the cost-benefit analysis for U.S. companies. While large corporations may be able to absorb the additional cost, smaller businesses and startups could struggle to justify sponsoring foreign workers under the H-1B program.


Possible Exemptions


The White House has indicated that physicians may be exempt, though official guidance is still pending. Additional exemptions may also be granted on a case-by-case basis, particularly if the applicant’s work is deemed to be in the national interest.


Related Policy Changes


Alongside the new fee, the administration has also proposed changes to the H-1B lottery system. These proposals aim to prioritize higher-wage jobs, shifting the program toward roles that require more specialized skills and pay.
