  • What is a family petition (I-130)?

    A family-based application begins with the I-130, Family Petition. The purpose of the I-130 application is to establish that there is a valid relationship between the petitioner and the immigrant. In addition to the application, you will need to submit sufficient documentation such as birth certificates, marriage licenses, divorce decrees, family photos, etc. At Wheeler Law, we recognize that every case is unique. As such, we will sit down together and decide which documents will make your petition as strong as possible.

  • Who can file an I-130 petition?

    United States Citizens or Legal Permanent Residents can file on behalf of: 

    • spouse
    • parent 
    • sons and daughters
    • brothers and sisters

  • What is the I-130 filing fee?

    The filing fee is $535.00. This fee is non-refundable and cannot be waived. The fee can be paid through money order, personal check, or cashier’s check. Depending on where the application is filed, you may also pay by credit card using Form G-1450, Authorization for Credit Card Transactions. If you pay by money order or check, you must make your check payable to the “U.S. Department of Homeland Security.”

  • I have a court scheduled before the immigration judge, do I have to attend?

    YES! You must attend all scheduled court appearances. The immigration judge can and will issue an order of removal (deportation) if you do not attend. 

  • What should I wear to my court appearances?

    If you are appearing for a Master Calendar Hearing, I recommend wearing clean jeans or slacks and a nice shirt, such as a blouse, button-down, or collared shirt. Make sure your shirt has sleeves and is not low cut. If you are appearing for an Individual Hearing, I recommend wearing business attire - slacks, formal dress, dress shirt, and tie, etc. 

  • I filed an I-130 for my spouse and it was approved. What are the next steps?
