Bond Hearings in Immigration: Urgency in Light of Matter of Yajure Hurtado

When someone is detained by immigration authorities, one of the first questions is whether they can be released on bond while their case is pending. Traditionally, immigration judges decide bond by looking at two key factors:

  • Whether the person is a danger to the community, and
  • Whether they pose a flight risk (a likelihood of not showing up to court).

If the judge found you were not a danger and not a flight risk, there was a chance for bond and release.

But now, with the new Matter of Yajure Hurtado decision (September 5, 2025), the situation has changed drastically. The Board of Immigration Appeals ruled that people who entered the U.S. without being admitted or paroled (unlawful entry) are considered “applicants for admission” under the law. This means they are not eligible for bond hearings at all—they must fight their cases while in custody.

Why This Matters

This new ruling creates a sense of urgency for our community. Many people who have lived in the U.S. for years, working and raising families, could now face months or even years of fighting their case from inside a detention center. Without preparation, families can be left vulnerable, and assets unprotected.

What You Can Do Now

Because of this urgent change, it is critical to take proactive steps before detention happens:

  1. Protect Your Family:
  • Call our office today to prepare a Power of Attorney or Parental Rights forms if you have children. This ensures your loved ones and your assets are protected if you are detained.
  1. Collect Your Evidence Now:
  • Begin gathering proof of your time in the U.S., your family ties, work history, community support, and any other documents that strengthen your case. Having these ready can make all the difference if you must fight from custody.
  1. Act with Urgency:
  • Do not wait until detention to act. The new law means waiting could take away opportunities you may have had in the past.
