Bond Hearings in Immigration: Urgency in Light of Matter of Yajure Hurtado

When someone is detained by immigration authorities, one of the first questions is whether they can be released on bond while their case is pending. Traditionally, immigration judges decide bond by looking at two key factors:

  • Whether the person is a danger to the community, and
  • Whether they pose a flight risk (a likelihood of not showing up to court).

If the judge found you were not a danger and not a flight risk, there was a chance for bond and release.

But now, with the new Matter of Yajure Hurtado decision (September 5, 2025), the situation has changed drastically. The Board of Immigration Appeals ruled that people who entered the U.S. without being admitted or paroled (unlawful entry) are considered “applicants for admission” under the law. This means they are not eligible for bond hearings at all—they must fight their cases while in custody.
